End User License Agreement (EULA)

1. Introduction

This End User License Agreement (“Agreement”) is a legal agreement between you (“User” or “You”) and All of My Issues! (“Company”, “We”, “Us”, or “Our”) for the use of Perry the Pumpkin (“Game”).

2. License Grant

The Company grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Perry the Pumpkin Game strictly in accordance with the terms of this Agreement.

3. Restrictions

You agree not to, and you will not permit others to:

• License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the Perry the Pumpkin Game.
• Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of Perry the Pumpkin.
• Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of All of My Issues or its affiliates, partners, suppliers, or the licensors of the Perry the Pumpkin Game.

4. Intellectual Property

Perry the Pumpkin, including without limitation all copyrights, patents, trademarks, trade secrets, and other intellectual property rights, are, and shall remain, the sole and exclusive property of Rick Bodnar and All of My Issues.

5. Termination

This Agreement is effective from the date you first use the Game and shall continue until terminated. Your rights under this Agreement will terminate automatically without notice from the company, All of My Issues, if you fail to comply with any term(s) of this Agreement. Upon termination, you must cease all use of the Game and delete all copies of Perry the Pumpkin.

6. Disclaimer of Warranties

Perry the Pumpkin is provided to you “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, All of My Issues, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to Perry the Pumpkin.

7. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall All of My Issues or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of or in any way related to your use of or inability to use Perry the Pumpkin (Broom Dash) Game.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law principles.

9. Changes to this Agreement

All of My Issues reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
